This research focuses on sharia economic dispute settlement in Indonesian religious courts. The research method used combines normative legal and empirical socio-legal research. The results found that the perception and tendency of judges towards several sources of legal rules in assessing, weighing, and deciding a sharia economic case in the Indonesian Religious Courts, did not always rely on one KHES as a material source. In Indonesian law, judges cannot use only one source in resolving sharia economic disputes, such as the Book of Fiqh (Kitab Kuning) only. However, it is an equally important combination, and it can be seen from several decisions of the Religious Courts in Indonesia.
2022-07-31T04:21:20+00:00 Copyright (c) 2022 Aris Irawan, Fitri Wahyuni, Reza Hanifa, Asneliwarni, Rias Wita Suryani https://ejournal.iai-tribakti.ac.id/index.php/tribakti/article/view/2720 Online-Offline in Religion; Observing Islamic Learning Patterns in Online Media 2022-08-03T07:16:51+00:00 Achmad Muhibbin Zuhri amizuhri@uinsby.ac.id Jauharoti Alfin alfin_ftkuinsa2014@yahoo.com
This study aims to unravel the phenomenon of digital society in understanding and learning Islam through the internet. The current human tendency to rely on information available through smartphones has given birth to the reality of shifting learning patterns that do not have to meet directly with the teacher. Even the presence of a virtual teacher is considered sufficient to justify an excellent religious way. This study uses a qualitative method with a netnographic approach that intends to reveal social phenomena in cyberspace. This method uses a particular analytical technique offered, AMS (Siber Media Analysis), which goes through 4 levels: Media room level, media document level, media object level, and experience level. This study found that online internet users can access information about religious rituals and procedures for doing them. So, internet users are part of the world's religious adherents who carry out the same religious creed. On the other hand, religious authority as a source of knowledge in learning Islam on the internet is not always institutional but can also be individual. As a result, the Islamic pattern of understanding Islam among netizens is more accessible, inclusive, egalitarian, and shows multidimensional interactions between individuals and other religious groups.
2022-08-02T07:58:03+00:00 Copyright (c) 2022 Achmad Muhibbin Zuhri, Jauharoti Alfin https://ejournal.iai-tribakti.ac.id/index.php/tribakti/article/view/2833 Epistemology of the Integration of Religion and Science Qur'anic Perspective 2022-08-19T05:29:22+00:00 Husein Aziz huseinaziz0301@gmail.com
The problem facing contemporary epistemology is the dichotomy between revelation, reason, and the senses. The West prioritizes reason and senses, ignoring revelation, causing civilization to deviate from its nature. Eastern Islam puts forward revelation that ignores reason and senses so that it cannot solve contemporary problems because its knowledge is not built on natural and social laws. This paper is intended to answer this epistemological problem by using a philosophical method with a library research approach. From this discussion, it was found that there are three tools for producing knowledge according to the perspective of the Qur'an, namely, revelation, reason, and the senses. Revelation is a tool to know the unseen while reason and senses are tools to produce natural and social domains. All of these tools are combined and integrated into obtaining the expected knowledge.
2022-08-07T03:57:45+00:00 Copyright (c) 2022 Husein Aziz https://ejournal.iai-tribakti.ac.id/index.php/tribakti/article/view/2018 Model of Strengthening Nationalism and Mapping Radical Understanding in Pacitan Islamic Boarding Schools 2022-08-10T05:44:59+00:00 Mukodi Mukodi mukodisumarno@gmail.com
The purpose of this study was to describe the vital elan of nationalism in students' souls, explain students' understanding of the dangers of radicalism, analyze the model of strengthening nationalism in Islamic boarding schools, and analyze the mapping model of radicalism in Islamic boarding schools. This paper reviews Muslim family law (mudawanah al-usrah) in Marocco. Based on a literature research method that uses a normative juridical approach with a statutory approach, this paper aims to discuss the challenges and opportunities in guaranteeing women's rights in Moroccan family law. The study indicates that mudawanah al-usrah is a meeting point between Islamic rules and international conventions, providing a new identity for Moroccan society, especially women and their rights. This reform was also influenced by the Islamic feminist movement, which produced reforms to improve gender equality in Moroccan society. That was also expected to provide an overview of the protection of women's rights in family law, especially in Morocco, and become material for evaluation in its implementation in society. This study is also expected to be a reference for activists of family law studies to continue to develop the protection of women's rights in Islamic family law.
2022-08-22T07:33:52+00:00 Copyright (c) 2022 Sheila Fakhria, Siti Marpuah https://ejournal.iai-tribakti.ac.id/index.php/tribakti/article/view/2328 Interfaith Religious Harmony in Besowo Kediri Landscape 2022-08-23T07:39:34+00:00 Khainuddin Khainuddin khoiruddinmajid@gmail.com M Thoriqul Huda huda@iainkediri.ac.id
Religious people realize the importance of maintaining religious harmony, tolerance in religion is needed in conditions of heterogeneous community areas. In the socio-political context, the ulama and umara synergize with each other to realize the unity and harmony of the people in religion and the state. In reality, some Islamic organizations led by ulamas create a commotion in the country and are very opposed to the umara policy, causing divisions among community groups. Based on the problems above, the study's results show that (1) the involvement of ulama and umara in the political stage is not new. That strong support from the Shari'a is exemplified by the Prophet Muhammad and Khulafa Ar-Rashidin. (2) Ulama and umara should create an ideal society, namely a society that is independent and runs on the correct principles.
